TERMS & CONDITIONS

These Terms of Service and Membership Terms (“Terms”) govern your use of the services offered by Degree Pilates LLC (“Degree,” “we,” “us,” or “our”), including our studio, classes, memberships, class packages, website, mobile application, retail offerings, events, and related services.

By creating an account, purchasing or booking a service, or participating in a Degree class or program, you acknowledge and agree to these Terms, together with any additional terms presented at the time of purchase.

Nothing in these Terms is intended to waive or limit any consumer right that cannot lawfully be waived under Massachusetts law.

1. Agreement & Services

Degree provides heated and non-heated mat Pilates, Pilates-inspired sculpt and strength classes, movement and fitness programming, workshops, events, and other related services.

Degree may modify or introduce class formats, programming, equipment, schedules, and services from time to time.

Descriptions of class temperatures are approximate. Actual studio temperature and humidity may vary.

Participation in Degree classes is also subject to Degree's Client Liability Waiver, Assumption of Risk & Safety Acknowledgment.

2. Eligibility / Minors

You must meet Degree's minimum age requirements to participate in classes or use the studio.

Participants under eighteen (18) must have the consent of a parent or legal guardian and may be required to have a parent or legal guardian execute Degree's Liability Waiver and other applicable agreements on their behalf.

Degree reserves the right to establish additional age restrictions for particular classes, programs, or heated environments where reasonably necessary for safety.

3. Reservations & Waitlists

Class reservations must be made through our online scheduling platform, Mariana Tek, accessible through our website or mobile app. Classes and reservations are subject to availability.

Membership or ownership of unused class credits does not guarantee availability in any particular class.

When a class is full, clients may be permitted to join a waitlist. By joining a waitlist, you acknowledge that you may automatically be added to the class if a space becomes available within Degree's designated waitlist window.

If you can no longer attend, you are responsible for removing yourself from class and/or from the waitlist. Once added to a class from the waitlist, Degree's standard cancellation and no-show policies apply.

4. Cancellations, Late Cancels, No-Shows & Late Arrivals

Reservations must be cancelled through Degree's designated booking platform within the cancellation period communicated by Degree.

Cancellations made at least 12 hours before the scheduled class start time will be considered timely cancellations without penalty.

Cancellations made within 12 hours of class start time are considered late cancellations and will result in a $15 late-cancellation fee and/or loss of the applicable class credit, as disclosed for the membership or package being used.

Failure to attend a reserved class without cancelling is considered a no-show and will result in a $25 no-show fee and/or loss of the applicable class credit, as disclosed for the membership or package being used.

All cancellations and schedule changes must be made directly through your Mariana Tek account in the app or browser.

Studio doors close at the start of class time for safety and flow. If late to class, please communicate with us. Communication does not hold or reserve your spot. 

Clients should arrive on time. Degree may refuse entry after class begins or after any grace period established by Degree when late entry would create a safety concern or disrupt the class. A reservation lost because of late arrival may be treated as a no-show.

Degree may waive a fee in its discretion. A waiver on one occasion does not require Degree to waive a fee in the future.

Degree reserves the right to modify, substitute or cancel classes, instructors, formats or schedules at any time, including last-minute changes due to instructor illness, emergencies or unforeseen circumstances. In such cases, we will make reasonable efforts to notify affected clients as soon as possible. No refunds or credits will be issued for schedule changes, instructor substitutions or temporary studio closures beyond our control.

5. Class Packages & Credits

Degree may offer drop-in classes, class packages, promotional credits, and other class-based products.

The price, number of credits, expiration date, and material restrictions applicable to a package will be disclosed at the time of purchase.

Unless otherwise stated, class credits are personal to the purchaser and may not be shared, transferred, resold, or redeemed for cash.

Unused credits expire according to the terms disclosed at purchase.

Class packages and credits are non-refundable except where otherwise stated by Degree or required by law.

6. Memberships & Recurring Billing

Degree may offer recurring memberships providing a designated number of classes, unlimited classes, or other membership benefits.

The applicable price, billing frequency, included benefits, minimum commitment period, and other material terms will be disclosed before purchase.

Certain Degree memberships automatically renew. By purchasing an automatically renewing membership, you authorize Degree and its designated payment processor to charge your payment method according to the membership terms presented to you and accepted at enrollment.

For memberships subject to a minimum commitment, cancellation generally becomes effective after satisfaction of that commitment unless an earlier cancellation right is provided by the membership terms or applicable law.

After any minimum commitment period, a membership may continue on a recurring basis until cancelled according to the cancellation procedure disclosed at enrollment and applicable law.

Degree will clearly disclose recurring financial obligations and cancellation information before enrollment and will provide notices and cancellation mechanisms required by applicable law.

Promotional or founding-member rates may be subject to additional terms disclosed at purchase. If a promotional rate is conditioned upon continuous membership, cancellation or termination may result in permanent loss of that promotional rate.

Nothing in this section limits any cancellation right provided by Massachusetts law.

7. Massachusetts Cancellation Rights

Where a Degree purchase constitutes a contract for health club services subject to Massachusetts General Laws Chapter 93, the following statutory cancellation rights apply.

CONSUMER'S RIGHT TO CANCELLATION. YOU MAY CANCEL THIS CONTRACT WITHOUT ANY PENALTY OR FURTHER OBLIGATION BY CAUSING A WRITTEN NOTICE OF YOUR CANCELLATION TO BE DELIVERED IN PERSON OR POSTMARKED BY CERTIFIED OR REGISTERED UNITED STATES MAIL WITHIN THREE (3) BUSINESS DAYS OF THE DATE OF THIS CONTRACT OR THE DATE OF YOUR RECEIPT TO THE ADDRESS SPECIFIED IN THIS CONTRACT.

Degree will provide refunds required following a valid statutory cancellation within the period required by Massachusetts law.

ADDITIONAL RIGHTS TO CANCELLATION

You or your estate may also cancel this contract for any of the following reasons:

if upon a doctor's order, you cannot physically or medically receive the services because of significant physical or medical disability for a period in excess of three months;

in case of your death;

If the health club services to be provided under this contract are not available because the seller fails to open a planned health club or location, permanently discontinues operation of a health club or location, or substantially changes the operation of a health club or location.

If you move either your residence or your place of employment more than twenty-five miles from any health club operated by the seller or a substantially similar health club which will accept the seller's obligation under the contract.

Degree may request reasonable evidence supporting a statutory cancellation request where permitted by law. Any refund due following a qualifying statutory cancellation will be processed in accordance with Massachusetts law.

8. Payments & Refunds

Prices for classes, packages, memberships, events, and other services are displayed through Degree's website, application, booking platform, or at the studio.

You agree to provide and maintain a valid payment method for purchases and recurring memberships.

By making a purchase or enrolling in a recurring membership, you authorize Degree and its designated payment processor to charge the payment method associated with your account for the amounts properly disclosed and agreed to, including applicable recurring membership charges and properly disclosed late-cancellation or no-show fees.

Except where otherwise stated or required by law, purchases are final and non-refundable.

Degree may issue a refund, account credit, or other accommodation in individual circumstances at its discretion. Doing so on one occasion does not create an obligation to provide the same accommodation in the future.

Nothing in this section limits refund or cancellation rights provided by applicable Massachusetts law.

9. Studio Conduct & Safety

Clients must comply with reasonable studio rules, posted safety requirements, and instructions from Degree staff and instructors.

Clients are expected to treat instructors, staff, and other clients respectfully and may not engage in harassment, discrimination, threatening behavior, intentional property damage, theft, unsafe conduct, or behavior that materially disrupts a class or the studio environment.

Clients are responsible for using equipment appropriately and following applicable safety instructions.

Degree may deny entry or remove a client from a class when reasonably necessary to protect the safety of that client, other clients, staff, or the studio.

Clients are responsible for their personal belongings. To the fullest extent permitted by law, Degree is not responsible for ordinary loss, theft, or damage to unattended personal property.

10. Physical Ability & Client Responsibility

You are responsible for determining whether you are physically and medically able to safely participate in Degree classes and activities. You should consult a qualified healthcare provider before beginning a new exercise program or participating in heated exercise if you have questions or concerns about your ability to participate safely.

By choosing to participate, you represent that, to the best of your knowledge, you are physically able to participate and have not been advised by a healthcare provider to refrain from the type of physical activity in which you are participating.

If you are pregnant, postpartum, injured, recovering from surgery, have a medical condition, take medication that may affect your ability to exercise or tolerate heat, have been advised to limit physical activity, or otherwise have concerns about participating safely, you are responsible for obtaining appropriate medical guidance before participating.

You are responsible for monitoring your own physical condition during class. You should stop, rest, modify movements, or leave the class at any time if you experience pain, dizziness, nausea, weakness, unusual shortness of breath, chest pain, overheating, discomfort, or otherwise feel unwell.

Degree instructors may provide general movement instruction, modifications, and safety guidance, but Degree and its instructors do not provide medical advice, diagnose medical conditions, or determine your individual medical fitness to exercise.

Degree reserves the right to restrict or discontinue a client's participation when Degree reasonably believes continued participation may create an immediate safety concern. Degree may request medical clearance before permitting continued participation where reasonably appropriate.

11. Retail Purchases

Degree may sell apparel, accessories, grip socks, fitness products, beverages, wellness products, and other merchandise.

Retail purchases are subject to the return or exchange policy disclosed at purchase or posted by Degree.

Certain products may be final sale for hygiene, safety, or other reasons where permitted by law.

Nothing in Degree's retail policy limits rights provided by applicable consumer law.

12. Website, App & Intellectual Property

Degree's website and mobile application are provided for purposes including account management, class reservations, purchases, studio information, and communications.

You are responsible for maintaining the confidentiality of your account credentials and for notifying Degree of suspected unauthorized access to your account.

Degree's name, logos, trademarks, photographs, videos, graphics, class names, written materials, website content, designs, and other proprietary materials are owned by or licensed to Degree and may not be reproduced, distributed, sold, or commercially used without prior authorization.

Degree may use third-party platforms to provide booking, payment, website, and application functionality. Use of those services may also be subject to the applicable provider's terms.

13. Privacy

Degree collects and uses personal information in accordance with its Privacy Policy.

The Privacy Policy explains the types of information Degree may collect, how information may be used or disclosed, the service providers that may process information on Degree's behalf, and choices available regarding certain communications and personal information.

14. Mariana Tek SMS Terms

  1. Program Description
    By opting in, you agree to receive recurring automated text messages from Degree Pilates LLC (“Degree”, "we," "us," "our") at the mobile number you provided. Messages may include [appointment reminders, order updates, account alerts, promotional offers, customer support follow-ups, etc. — customize to your actual use case]. Consent to receive these messages is not a condition of any purchase.

  2. Message Frequency
    You may receive up to 30 messages per [week/month]. Message frequency may vary depending on your activity and interactions with us.

  3. Message and Data Rates
    Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Please contact your wireless carrier for details about your messaging plan.

  4. How to Opt Out and Get Help
    You can unsubscribe the SMS service at any time by replying STOP to any message we send you. After you send STOP, you will receive a one-time confirmation message, and no further messages will be sent. If you want to rejoin, you can sign up again using the original opt-in method or reply START. For help or more information at any time, reply HELP to any of our messages.   5. Carrier Liability Disclaimer
    Carriers are not liable for any delayed or undelivered messages.

15. Right to Refuse / Terminate Service

Degree reserves the right to refuse service, suspend an account, restrict studio access, or terminate a client's ability to participate where the client violates these Terms, engages in unsafe or unlawful conduct, threatens or harasses clients or staff, intentionally damages property, repeatedly disrupts studio operations, or otherwise creates a material safety or operational concern.

Any cancellation, refund, or continuing payment obligations following termination will remain subject to the applicable membership terms and Massachusetts law.

16. Changes to Terms

Degree may update these Terms from time to time to reflect changes in studio operations, services, policies, technology, or applicable law.

The current version will be posted with an updated effective date.

Material changes affecting an existing paid membership will be communicated and implemented as required by applicable law and the applicable membership agreement.

17. Massachusetts Law / Severability / Contact

These Terms are governed by the laws of the Commonwealth of Massachusetts.

If any individual provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law, except where applicable law provides otherwise.

Nothing in these Terms is intended to waive or restrict any right or remedy that cannot legally be waived.
